1. Purpose of this Legal Notice
This Legal Notice governs access to, browsing of, and use of the website ebiketourlanzarote.com (hereinafter, the "Website"), as well as the liabilities arising from its use, in accordance with the provisions of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (hereinafter, "LSSI-CE"), and other applicable Spanish and European Union legislation.
Use of the Website confers the status of user (hereinafter, the "User") and implies full and unreserved acceptance of each and every provision contained in this Legal Notice, in the version published at the time it is accessed. The User must therefore read this Legal Notice carefully each time they intend to use the Website, since it and its terms of use may be amended.

3. Purpose and scope of the Website
The purpose of the Website is to provide information about the guided electric bicycle routes organised by Ebike Experiences Lanzarote, and to enable the booking and payment of such routes through the booking systems integrated into the Website itself (managed by FareHarbor and by the direct Stripe payment system). This Legal Notice governs exclusively access to and use of the Website as a digital channel; the specific terms governing the contracting of the guided route service are set out in the separate document "Booking Terms & Conditions", which the User must review and expressly accept when completing any booking.
4. Terms of access and use
Access to the Website is free of charge, save for the cost of the telecommunications connection supplied by the access provider contracted by the User. The User undertakes to make appropriate, diligent and lawful use of the Website, and in particular undertakes to refrain from:
- Using the Website for unlawful, fraudulent purposes or purposes contrary to good faith or public order, or in any other way that may be harmful to the rights of third parties, or that may in any way damage, disable, overload or impair the Website, or prevent its normal use by other users.
- Causing damage to the physical or logical systems of the Website, its suppliers or third parties.
- Introducing or spreading computer viruses or any other physical or logical systems liable to cause the damage referred to above.
- Attempting to access, use or manipulate the data of the owner, other users or third parties without due authorisation.
- Reproducing, copying, distributing, making available to third parties, publicly communicating, transforming or modifying the contents of the Website, unless authorised by the holder of the corresponding rights or where legally permitted.
- Using the contents of the Website and, in particular, the information obtained through it, to send advertising, direct-marketing communications or communications for any other commercial purpose, or to collect or store third parties' personal data.
Route bookings are managed through the FareHarbor platform and, alternatively, through the direct Stripe payment system integrated into the Website itself. Both platforms are governed by their own terms of use and privacy policies, independent of those of the Owner, which the User must review and accept when finalising the booking.
5. Intellectual and industrial property
All the contents of the Website, including, without limitation, texts, photographs, graphics, images, icons, logos, colour combinations, structure and design, selection of materials, computer programs necessary for its operation, access and use, and source code (hereinafter, the "Contents"), are the property of Ebike Experiences Lanzarote or of third parties who have authorised their use, and are protected by Spanish and EU intellectual and industrial property legislation, including the Consolidated Text of the Intellectual Property Law (Royal Legislative Decree 1/1996).
The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of the Contents is expressly prohibited without the prior express authorisation of Ebike Experiences Lanzarote or, where applicable, of the third-party holder of the corresponding rights. The trade name "Ebike Experiences Lanzarote", its logo and other distinctive signs used on the Website are protected by industrial property legislation and may not be used without express authorisation.
Any User who submits content to the Website (for example, through the contact form) warrants that they hold the rights necessary to do so and that such content does not infringe third-party rights or applicable legislation.
6. Disclaimer of warranties and liability for the operation of the Website
Ebike Experiences Lanzarote does not warrant the availability, continuity or infallibility of the Website's operation, and therefore excludes, to the extent permitted by law, any liability for damages of any kind that may arise from:
- The unavailability, lack of maintenance or effective operation of the Website or of its services and contents, as well as interruptions, connection errors, disconnections, delays or blockages caused by deficiencies or overloads on the internet or in any of the systems.
- The presence of viruses or other harmful elements in the contents that may cause alterations to the User's computer systems, electronic documents or files.
- Failure by third parties to fulfil their obligations or commitments relating to the services provided to Users through the Website, in particular FareHarbor, Stripe, Repuso, or any web hosting provider.
- Improper or unlawful use of the Website by the User, as well as decisions made on the basis of information contained on it.
Ebike Experiences Lanzarote reserves the right to make, at any time and without prior notice, changes and updates to the information contained on the Website, as well as to its configuration, presentation and conditions of access. Ebike Experiences Lanzarote will carry out, whenever there are no causes making it impossible or difficult to do so, and as soon as it becomes aware of errors, disconnections or lack of updating of the contents, all actions aimed at correcting such errors, restoring communication and updating the contents.
The provisions of this section are without prejudice to any liability that Ebike Experiences Lanzarote may have in its capacity as provider of the contracted guided route service, which is governed in full by the Booking Terms & Conditions.
7. Third-party links and integrations
The Website may include links, widgets or embedded content from third parties — including, among others, FareHarbor, Stripe, Repuso, and social networks such as Facebook, Instagram and TikTok — over whose content, privacy policies, cookies or operation Ebike Experiences Lanzarote has no control and assumes no liability whatsoever. Access to these services through the Website is subject to the terms of use and policies of each third party, which the User must review independently.
The existence of links to other websites does not imply the existence of agreements with the persons or entities responsible for or owning them, nor any recommendation, promotion or identification of Ebike Experiences Lanzarote with the statements, contents or services provided.
8. Protection of personal data and cookies
The processing of Users' personal data is governed by the Website's Privacy Policy, and the use of cookies by the Cookie Policy, both accessible from any page of the Website and forming an integral part of this Legal Notice.
9. Dispute resolution and complaints
In accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes, Users who are consumers are informed that, in the event of a dispute relating to a purchase made through the Website, they may use the European online dispute resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr, without prejudice to their right to bring proceedings before the ordinary courts or before the relevant Consumer Arbitration Board.
10. Governing law and jurisdiction
These terms are governed by Spanish law. For the resolution of any dispute arising from access to, browsing of or use of the Website, the parties submit to the courts and tribunals of Arrecife de Lanzarote, expressly waiving any other jurisdiction to which they might be entitled, unless consumer protection legislation mandatorily provides otherwise, in which case the jurisdiction determined by such legislation shall apply.
11. Invalidity and ineffectiveness of clauses
Should any clause contained in this Legal Notice be declared, wholly or partly, null or ineffective, such nullity or ineffectiveness shall affect only that provision or the part of it that is null or ineffective, and the Legal Notice shall remain in force in all other respects, with that provision, or the affected part of it, being deemed not to have been included.
12. Amendments to this Legal Notice
Ebike Experiences Lanzarote reserves the right to make, without prior notice, such amendments to the Website as it considers appropriate, and may change, remove or add both the content and services provided through it and the way in which they are presented or located. The current version of this Legal Notice will always be the one published on the Website itself, indicating the date of its last update.
